The Sixth Administrative Court of Appeals in Kyiv has confirmed the decision of the District Administrative Court to declare illegal and cancel the order of the Kyiv City Military Administration approving tariffs for paid parking in Kyiv. As a result, starting from February 21, parking fees in Kyiv cannot be collected. This was announced on Facebook by the head of the Northern Interregional Territorial Department of the Antimonopoly Committee of Ukraine, Oleksiy Khmelnytsky.

«The court decision has entered into force… We are expecting new and justified tariffs from the Kyiv authorities,»

noted the representative of the Antimonopoly Committee.

He explained that the Appeals Court confirmed that the order of the Kyiv City Military Administration No. 735 dated November 7, 2022, regarding the establishment of tariffs, is illegal.

The issue concerns the tariffs set by the Kyiv Municipal Enterprise «Kyivtransparkserveis» for the use of parking lots for transportation vehicles, including 35 UAH per hour in the first zone (25 and 5 UAH in the second and third zones, respectively).

Khmelnytsky reminded that on October 13, 2023, the temporary adminkollegia of the Antimonopoly Committee found that parking prices in Kyiv are inflated. The fine for two repeated violations of the competitive legislation by «Kyivtransparkserveis» amounted to 6.6 million UAH.

The collegium recognized that the Municipal Enterprise, which calculated the price for parking services in the capital at 35 UAH per hour, abused its monopolistic position, and the Kyiv City Military Administration «legitimized» this violation. As a result of the review, the Antimonopoly Committee fined the Kyivtransparkserveis Municipal Enterprise 3.3 million UAH and instructed the communal services and the Kyiv City Military Administration to cease the violations.

The Antimonopoly Committee noted that this is not the first violation by communal services identified in this market. Earlier, the regulator found that the enterprise demanded additional payment from winners of electronic auctions for the right to place/set up parking lots and imposed fines for refusal to conclude a contract or sign acceptance-transfer acts. As a result, in July 2021, the Municipal Enterprise was fined 2.6 million UAH.
